In the US, enough court cases have gone down to establish that artists may use even material under copyright or trademark so long as it demonstrates artistic merit, including selling and distributing (though it can get tricky if defamation is involved). Most infamously, Mattel levied suit against an artist using Barbies in his sculptures. They lost.
I think they're just warning him not to use "Doctor Who" as a marketing tool - which is perfectly legitimate on their part. *shrugs* Well, I don't know much about this specific case.
